Examples of such off-the-clock conditions include:
– Working during unpaid lunch breaks, such as assisting customers or co-workers in the store;
– Handling communications such as calls, texts, emails, or GroupMe messages with customers or other employees while away from the store or on your days off.
– Due to labor budget restrictions, not being able to recover all time worked and report overtime hours.
We are pursuing these claims through a process called arbitration, which is often considered less formal than court. This is because of agreements the company had employees sign that require filing claims with the American Arbitration Association, rather than in court.
